Feminized Seed Laws Update 2023

Feminized seed laws are murky for some states, however do not blame the Federal Government. The Federal 2018 Farm Bill defines the seeds (yes, the actual seed itself) as “fiber” seeds if they contain less than 0.3% chemically. The DEA has reiterated this fact on more than one occasion. More recently in early 2022, the DEA sent a reply letter to an inquiry by Vicente Sederberg’s Shane Pennington, clarifying that they contain less than 0.3% chemically on a dry weight basis — are in fact legal under the 2018 Farm Bill. Previously, Mr. Pennington sent them a letter requesting clarity on those seed laws.

The crux of the entire seed law issue is the DEA’s letter created a state-federal disconnect. As a result, many seed customers and seed makers have been curious about whether state or federal law takes precedent nonetheless.
